SECTION 14 – INDEMNIFICATION

You agree to defend, indemnify and hold harmless Amoz, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including reasonable attorneys’ fees) arising from:

  3. your violation of any third-party right, including without limitation any intellectual property, privacy, or publicity right; or

  4. any claim that your content caused damage to a third party.
    This defense and indemnification obligation will survive these Terms and your use of the Service.

SECTION 15 – SEVERABILITY

If any provision of these Terms is held to be unlawful, void or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the fullest extent permissible and the remaining provisions will remain in full force and effect. The invalidity of any provision shall not affect the validity of the rest of these Terms.

  3. Survival: All provisions which by their nature should survive termination shall survive, including but not limited to Sections 4 (Intellectual Property), 13 (Disclaimer & Liability), 14 (Indemnification), 15 (Severability), 17 (Entire Agreement) and 18 (Governing Law).

These Terms, together with our Privacy Policy and any other policies published by us on the Service, constitute the entire agreement between you and Amoz regarding your use of the Service, superseding any prior or contemporaneous agreements, whether written or oral. These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. You agree that any dispute will be subject to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make changes, we will post the updated Terms on this page and update the “Last Updated” date. It is your responsibility to review these Terms periodically. Your continued use of the Service after any changes constitutes acceptance of those changes.
